Consent at Registration
By tapping "I Agree" or "Register", you explicitly consent to the following:
- These Terms & Conditions, including all disclaimers and limitations of liability.
- Our Privacy Policy, available within the App.
- The collection, processing, and storage of your personal data as described in Section 6.
- Receiving transactional and promotional communications. You may opt out of marketing at any time.
You confirm that you are at least 18 years old, or have legal capacity to enter into binding agreements.
Platform Overview & Role of Mapmark
Mapmark connects two types of users:
- Post Creators — users who list rental properties or job posts (home rent, shop rent, office space, tuition, and more).
- Post Explorers — users who search, view, and respond to those posts.
Mapmark is not a lessor, lessee, agent, broker, or party to any rental transaction. We do not own, inspect, verify, or endorse any property, space, or user. We provide the venue; the agreement is between you and the other party.
No contractual relationship exists between Mapmark and any third-party regarding an actual rental agreement.
User Responsibility for Post Content & Accuracy
You are solely responsible for the accuracy, legality, completeness, and truthfulness of everything you post, including property address, photos, pricing, availability, amenities, legal permissions, and any claim regarding ownership or authority to rent.
Mapmark does not verify post content. If your listing is false or misleading, you bear all legal and financial consequences.
Mapmark does not inspect properties. Reliance on any post is at your own risk. You are responsible for physically inspecting the property, verifying ownership and legal compliance, and requesting documentation from the owner.
You agree to indemnify and hold harmless Mapmark, its affiliates, officers, and employees from any claims, damages, or expenses arising from your posted content, violations of law, or your interactions with other users.
Subscription Fee & Payment Terms
- Access to certain features may require a subscription fee (monthly, yearly, or per-post).
- All fees are shown before payment and are non-refundable except where required by law.
- Mapmark uses third-party payment gateways. We do not store your full payment card details.
- Mapmark may update fees with advance notice via in-app notification or email.
Scope of Mapmark's Liability
Mapmark provides the App "as is" and "as available" — without warranties of merchantability, fitness for a particular purpose, or non-infringement. Mapmark does not guarantee you will find a rental, that any post is accurate, or that any user is trustworthy.
Mapmark is not liable for:
- Direct, indirect, incidental, or consequential damages arising from user interactions, posts, or property visits.
- Failures or delays in App performance due to technical issues or third-party services.
- Acts or omissions of any user, including misrepresentation or failure to honor an agreement.
Mapmark's maximum aggregate liability shall not exceed the total subscription fees you paid in the 6 months before the claim.
User Data Protection & Privacy
Mapmark collects and stores personal data (name, phone number, location, payment info) only as needed to operate the service: account creation, posts and searches, payments, communications, and legal compliance.
We use encryption, access controls, and secure servers to protect your data from unauthorized access, alteration, or destruction.
We do not sell your data. We may share it with service providers under confidentiality agreements, or with law enforcement when legally required.
Request access to, correction of, or deletion of your data by emailing mapmark.info@gmail.com. Some data may be retained for legal purposes.
If you use the App outside Bangladesh, your data may be transferred to servers in other countries, subject to applicable data protection laws.
Prohibited Conduct
You agree not to:
- Post false, fraudulent, misleading, or illegal rental listings.
- Use the App for any purpose outside genuine rental marketplace activity.
- Harass, threaten, or defraud other users.
- Scrape, crawl, or copy App content without written permission.
- Violate any applicable law regarding rental properties, housing discrimination, or data privacy.
Violations may result in immediate account suspension or termination without refund.
Termination
Mapmark may suspend or terminate your account at any time, with or without cause, including for violations of these T&Cs. When terminated:
- Your access to posts and subscriptions ends immediately.
- You remain liable for all actions taken before termination.
Dispute Resolution & Governing Law
- Governing law: These T&Cs are governed by the laws of Bangladesh, without regard to conflict-of-laws principles.
- Arbitration: Disputes shall be resolved through binding arbitration in Dhaka — except that either party may seek injunctive relief in court for IP or data security matters.
Modifications to T&Cs
Mapmark may update these Terms from time to time. We will notify you via in-app notification or email at least 7 days before material changes take effect. Continuing to use the App after the effective date means you accept the revised Terms.
